General Provisions
- This policy defines how we use and process your personal data in connection with your use of our website. We process personal data in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), the Personal Data Protection Act of 10 May 2018, and the Act of 18 July 2002 on the provision of electronic services.

Data Controller Details
- GRUPA TORUS S.A, with its registered office in Gdańsk, is the parent company of the TORUS Capital Group (hereinafter referred to as the „GRUPA TORUS”).
- Depending on the purposes of personal data processing, the relevant and separate controller of your personal data may be the relevant company within the GRUPA TORUS. Information about which entity is the controller in a given case is provided each time data is collected, in particular via contact forms or in the content of concluded agreements.
- If you are interested in receiving commercial information for marketing purposes regarding development investments by companies within the GRUPA TORUS (including information about current and future development investments by companies within the GRUPA TORUS, offers, promotions, and the launch of sales of a given investment) and you express your wish to receive such information electronically or by telephone, the controller of your personal data is GRUPA TORUS S.A. with its registered office in Gdańsk.
- In the event of concluding a reservation agreement or other agreements regarding the purchase of premises, the controller of your personal data will be the relevant special purpose vehicle within the GRUPA TORUS, which is the investor in the investment and a party to the agreement.
- If you use the website to learn about the GRUPA TORUS offerings, the controller of your personal data is GRUPA TORUS S.A., with its registered office in Gdańsk.
- In the case of business cooperation (including general contracting, property management, design services), the controller of your personal data is TORUS sp. z o.o., with its registered office in Gdańsk – the entity with which the contract is concluded.
Use of the website
- When using the website, the following information is collected: IP address, URL address, data regarding user activity on the website, dates and times of visits, information about the browser, operating system, and Internet service provider.
- Data is collected via:
– cookies (after obtaining consent),
– analytical tools (e.g., Google Analytics),
– contact forms.
- Data is processed to ensure the proper operation of the website, conduct statistical analyses, and develop its functionalities. The legal basis for processing is the company’s legitimate interest (Article 6, Section 1, Letter f of the GDPR).

- When you complete the contact forms available on our website, we collect the following data: name and surname, email address, telephone number, preferred premises, and other preferences regarding the selection of premises.
- The contact form is completed for the purpose of handling your inquiry (including presenting offers regarding companies from the TORUS GROUP). The legal basis for data processing to take action at your request before entering into a contract or to respond to your inquiry is Article 6(1)(b) of the GDPR or Article 6(1)(f) of the GDPR (legitimate interest – communication with the user). To the extent that the data will be processed for direct marketing purposes of companies from the GRUPA TORUS in the future, the legal basis is your voluntary consent (Article 6(1)(a) of the GDPR). - Your personal data may also be processed by us to establish, pursue, or defend against legal claims related to the use of the website, or the processing of your personal data – as processing is necessary to pursue our legitimate interest (Article 6, paragraph 1, letter f of the GDPR), which is the ability to establish, pursue, or defend against legal claims.
- Your personal data will be processed by us for various periods, depending on the purpose:
– use of the website, analytical purposes, quality improvement, development, repair, or testing – until you close your web browser (so-called session cookies) or until you delete cookies from your browsing history in your web browser (so-called persistent cookies);
– in the case of data processing based on consent (e.g., to receive marketing offers), we store data until you withdraw your consent;
– in the case of data processing based on contractual relationships established with us, we store data until the periods under which you or we could have the right to bring a claim expire;

Personal data is not used for automated decision-making, including decisions that produce legal effects for you or significantly affect you in a similar manner.

– the European Commission decision of 10 July 2023 on the adequacy of the personal data protection provided by the EU-US Data Privacy Framework, or
– standard contractual clauses adopted by the European Commission, along with the application of additional safeguards.
Rights regarding the processing of your personal data
- Providing personal data in connection with your consent is always voluntary, and failure to provide it (refusal or withdrawal of consent) does not entail any negative consequences for you on this website, but may hinder your use of this website (for technical reasons). However, when using the contact form, providing data (such as email address or phone number) is necessary to process and respond to your inquiry – failure to provide it will prevent us from contacting you.
- You have the right to access your personal data processed by us and to receive a copy of your data processed by us.
- You have the right to request rectification (correction, addition) of your data, restriction of processing, deletion, or transfer.
Where justified by your particular situation, you have the right to object to the use of data based on our legitimate interests or for the purpose of establishing, pursuing, or defending against legal claims. However, please note that, in accordance with the law, we may refuse to uphold your objection if we demonstrate that:

- You have the right to file a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates personal data protection regulations.
- To the extent that processing is based on consent (e.g., direct marketing), you have the right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
